Terms and Conditions

1. Operator identification

ArtiYacht is a digital platform operated by Fernando Artiach Careaga, a natural person domiciled in the Republic of Panama. Contact email: soporte@artiyacht.com.

2. Nature of the service

ArtiYacht is an intermediation platform that connects boat owners with independent providers of marine technical services and marine parts and spares. ArtiYacht does NOT provide marine services directly, does NOT supply parts directly, and does NOT guarantee the quality or outcome of services or parts provided by providers registered on the platform.

3. Limitation of liability

ArtiYacht shall not be liable, directly or indirectly, for:

  • The quality, suitability, or outcome of services provided by providers.
  • Material, personal, or any other damages arising from services or parts supplied by providers.
  • Delays, defaults, or cancellations by providers.
  • The accuracy, truthfulness, or completeness of information provided by providers in their profiles.
  • The quality, authenticity, or compatibility of parts and spares supplied through the platform.

The user acknowledges and accepts that any engagement of services or acquisition of parts through ArtiYacht is at their own responsibility and risk.

4. Relationship with providers

Providers registered on ArtiYacht are independent third parties. They are not employees, agents, representatives, or subcontractors of ArtiYacht. ArtiYacht facilitates the connection between clients and providers but does not supervise, control, or direct the execution of services or the supply of parts. ArtiYacht performs a basic verification process for providers, but this does not constitute any guarantee regarding the quality of their services.

5. Payments and commissions

ArtiYacht charges a 15% commission on the value of contracted services, which is charged to the client. For parts and spares, ArtiYacht applies a commercial margin on the acquisition price. The payment scheme for services is 50/50: the client pays 50% upon confirming the service and the remaining 50% upon completion. ArtiYacht manages payments but does not guarantee the service or parts supplied.

6. Registration and personal data

By registering on ArtiYacht, the user accepts these Terms and Conditions and the Privacy Policy. Personal data provided will be processed in accordance with Panama's Law 81 of 2019 on Personal Data Protection and its regulations.

7. Intellectual property

All content on the ArtiYacht platform, including but not limited to text, designs, logos, images, source code, and user interface, is the exclusive property of ArtiYacht and is protected by applicable intellectual property laws. Unauthorized reproduction, distribution, or use is prohibited.

8. Dispute resolution

Disputes between clients and providers are the sole responsibility of the parties involved. ArtiYacht may mediate in good faith at the request of either party but is not obligated to do so nor assumes responsibility for the outcome of such mediation. The applicable law to these Terms is the law of the Republic of Panama, and any controversy shall be submitted to the jurisdiction of the competent courts of Panama.

9. Modifications

ArtiYacht reserves the right to modify these Terms and Conditions at any time. Modifications will be communicated to registered users by email at least 15 days in advance. Continued use of the platform after notification implies acceptance of the modified terms.
